Rekomendasi ITF untuk kontrak Anda untuk bekerja di laut

Jaminan terbaik dari kondisi kerja di laut hanya menandatangani kontrak dibuat sesuai dengan perjanjian kolektif ITF.
Jika tidak, berikut adalah daftar untuk diikuti:

Jangan mulai bekerja di kapal tanpa kontrak tertulis.
Jangan pernah menandatangani kontrak kosong atau suatu kontrak yang mengikat Anda dengan syarat dan kondisi yang tidak ditentukan atau bahwa Anda tidak akrab dengannya.
Periksa apakah kontrak yang anda tandatangani mengacu pada Perjanjian Kerja Bersama (KKB/CBA). Jika demikian, pastikan bahwa Anda sepenuhnya menyadari ketentuan PKB, dan menyimpan salinannya bersama dengan kontrak anda.
Pastikan bahwa durasi kontrak yang secara jelas dinyatakan.

Jangan menandatangani kontrak yang memungkinkan untuk adanya perubahan lamanya kontrak pada kebijakannya dari pemilik kapal. Setiap perubahan yang disetujui dalam kontrak harus dengan persetujuan bersama.
Selalu memastikan bahwa kontrak tersebut dengan jelas menyatakan upah pokok dan memastikan bahwa jam kerja dasar jelas (misalnya 40, 44 atau 48 jam per minggu). Organisasi Buruh Internasional menyatakan bahwa jam kerja dasar harus maksimum 48 jam per minggu (208 jam per bulan).
Pastikan bahwa kontrak jelas mengatur tentang waktu lembur yang dibayarkan dan pada tingkat apa. Mungkin ada jam flat rate dibayar untuk semua jam kerja lebih dari dasar. Atau mungkin ada jumlah tetap bulanan untuk sejumlah jaminan jam lembur, dalam hal tingkat untuk setiap jam kerja di luar lembur dijamin harus dinyatakan dengan jelas. ILO menetapkan bahwa semua jam kerja lembur harus dibayar minimum 1,25 x tarif per jam normal.
Pastikan bahwa kontrak dengan jelas menyatakan berapa hari cuti per bulan Anda akan mendapatkan. ILO menetapkan bahwa cuti tidak boleh kurang dari 30 hari per tahun (2,5 hari per bulan kalender).
Pastikan bahwa pembayaran upah pokok, lembur dan cuti secara jelas dan terpisah diperinci dalam kontrak.
Jangan menandatangani kontrak yang memungkinkan pemilik kapal menahan atau menerima sebagian dari upah anda selama masa kontrak. Anda berhak mendapatkan pembayaran penuh dari upah yang diperoleh pada akhir setiap bulan kalender.
Jangan pernah menandatangani kontrak yang mengandung klausul yang menyatakan bahwa Anda bertanggung jawab untuk membayar sebagian dari biaya keberangkatan atau biaya repatriasi.

Jangan menandatangani kontrak yang mengandung klausul yang membatasi hak Anda untuk bergabung, menghubungi, berkonsultasi atau diwakili oleh serikat pekerja pilihan Anda.

Sadarilah bahwa setiap kontrak pekerjaan tidak selalu mencantumkan rincian tunjangan tambahan. Oleh karena itu Anda harus mencoba untuk mendapatkan konfirmasi (lebih baik dalam bentuk perjanjian tertulis ) tentang besarnya kompensasi yg akan dibayarkan dalam hal:
– Sakit atau cedera selama periode kontrak
– Kematian (jumlah yang dibayarkan kepada keluarga terdekat)
– Hilangnya kapal
– Hilangnya barang pribadi akibat hilangnya kapal
– pemutusan kontrak sebelum waktunya.
Pastikan bahwa Anda akan diberi dan menyimpan salinan dari kontrak yang telah ditandatangani.
Ingat … apapun ketentuan dan kondisi, sebuah kontrak / perjanjian yang Anda masuki secara sukarela ,akan secara hukum, dianggap mengikat secara hukum.

OCIMF addresses seafarers work and rest hours (Nov  28  2012)

 

The Oil Companies International Marine Forum (OCIMF) has published new `Recommendations Relating to Requirements Governing Seafarers’ Hours of Work and Rest’.

 

“Safety and environmental protection is our greatest priority and OCIMF members see fatigue as a significant contributory factor to many incidents that occur within the shipping industry” explained OCIMF director, Capt David Cotterell.

 

“These recommendations set out our minimum expectations, which we hope that shipping companies will take into account to achieve compliance with IMO and ILO rules, prevent fatigue and reduce fatigue related incidents” Cotterell added. “We also hope that our recommendations will be of benefit to the wider industry as well.”

 

The recommendations were developed in co-operation with the International Chamber of Shipping (ICS) and the International Shipping Federation (ISF), who represent maritime employers during the negotiations at IMO and ILO on seafarers’ work and rest hours.

 

OCIMF acknowledged that international legislation on working hours has been in place for some time, but suggested that these provisions have been subject to varying interpretations by individual administrations, resulting in differing requirements for vessels operating under different flags.

 

The forum said that it believed that the new IMO and ILO regimes can make a difference, but to be effective, interpretations need to be replaced by clear, standardised requirements to and consistent enforcement to drive compliance

 

OCIMF’s recommendations aims to highlight potential ambiguities and differing interpretations of the requirements of applicable international conventions, including the 2010 Manila amendments to the IMO STCW Convention, which entered into force this year and the 2006 ILO Maritime Labour Convention applicable from August 2013.

 

As a consequence of the new international work/rest hour record regimes adopted by IMO and ILO, OCIMF said that it expected that port state control procedures would pay increasing attention to ensuring compliance with the requirements.

 

Given the importance attached to ensuring the proper management and recording of seafarers’ hours of work and rest, OCIMF recommended that purpose-developed computer software is used to manage seafarers work and rest hours on board ships, in order to demonstrate compliance with both IMO and ILO regulations and its own recommendations.

 

The OCIMF paper mentioned the ISF Watchkeeper Version 3.3 computer software as being suitable for this purpose, incorporating calculations and the ability to generate reports that are consistent with the oil companies’ recommendations.

 

ICS/ISF secretary general, Peter Hinchliffe, said: “We are pleased that OCIMF discussed the development of their policy with ISF and ICS, in view of our close involvement as the official social partner, which helped negotiate the ILO and IMO rest hour regulations on behalf of maritime employers.

 

“The Recommendations show that charterers, as well as governments, take the prevention of fatigue very seriously. We are pleased that OCIMF acknowledges the benefits of the ISF Watchkeeper program as a means of maintaining records that can demonstrate compliance with both international regulations and oil company requirements,” Hinchliffe said.

2. You have to go for The Basic DP Course first, if you have experience joining on DP vessel before you take the Basic course that will be an advantage. Why you have to attend The Basic Course? Becoz you have to know all the basic knowledge related to the DP equipments, operations etc..and from there you will know the DP further.

As soon as you have Basic DP cert, you have to join again on the DP vessel to complete your DP Log book as 1 month required that mentioned on the Log book to be familiarised with DP equipments onboard your vessel. Take note, your first experience with the DP vessel is depend of which DP Class your vessel equipped with.

5. There is no short cut on this course honey, and there is no “pass and not pass”. This course is intent to build the Professioanal DPO those competence to operate the DP equipments as well. In this case, for sure you have to improve your self as a Pro.

Kami ingin berbagi info terbaru yang kami terima mengenai DP Course di tahun 2012.
Seperti yang telah kami beritahukan di email yang lalu, bahwa di tahun 2012 ada persyaratan baru bagi yang hendak mendaftar/mengikuti DP Course, yaitu harus memiliki seritifikat STCW, namun setelah kontak dengan Mr. John Gorman Gorman di C-Mar Singapore, ada penjelasan terbaru mengenai hal tersebut, sbb:

1. Untuk pendaftaran DP Course, untuk sementara ini tetap diberlakukan persyaratan yang sama dengan sekarang, yaitu cukup dengan mengisi formulir pendaftaran dan scan passport yang expired date-nya masih di atas 6 bulan.

2. Tidak ada penahanan sertifikat bagi yang telah selesai mengikuti kursus, jadi apabila sudah mengikuti kursus DP Basic/Advance, akan tetap diberikan sertifikat DP Basic/Advance.

3. Sertifikat STCW hanya diminta/ditunjukkan apabila hendak mengambil sertifikat Full DPO.

1. When student want to register, do you need all the certificate as requirement to attend the course?
As of today, we have no plans to check on the eligibility of students to attend the DP Basic Course. The reason is that some students who
attend have no intention of completing the DPO scheme (Dive Supervisors, Drilling Superintendents, etc) but simply wish to learn more about DP. However, we will be drawing students
attention to the new entry requirements on the course registration form.

2. If have student that want to attend DPO course without STCW
certificate, it means that C-mar will hold his certificate first until
he got STCW cert or how is the procedure?
No, we will issue the DP Basic Course Certificate whether the student meets the new entry requirements or not.

3. Does C-Mar will held STCW course also? If have, please send us the schedule. If not, where to take the STCW certificate?
C-MAR does not conduct STCW courses. In Singapore, we recommend the
Singapore Maritime Academy (a division of the Singapore Polytechnic) for STCW courses.

Untuk saat ini biaya pendaftaran DP Course di C-Mar Asia Pte Ltd Singapore masih belum ada rencana perubahan/kenaikan harga untuk di awal tahun 2012, seandainya pun ada, biasanya di pertengahan tahun. Apabila sudah mendaftar dan sudah membayar lunas sebelum perubahan harga, ketika ada kenaikkan harga, tidak perlu menambahkan biaya lagi karena anda sudah membayar lunas sesuai dengan ketentuan/perjanjian saat itu.

Untuk pendaftaran disarankan dilakukan minimal 1,5 bulan sebelumnya untuk memastikan bahwa anda dapat seat untuk course yang diinginkan. Seandainya karena ada kepentingan mendadak sehingga harus mengubah jadwal, tinggal diberitahukan kepada kami paling lambat 2 minggu sebelum course berlangsung.

Untuk perubahan jadwal course, umumnya hingga saat ini tidak dikenakan biaya tambahan/denda/sanksi asalkan dikonfirmasikan terlebih dahulu.
Apabila terkena denda/sanksi, jumlah ditentukan oleh C-Mar dan kami hanya bertindak sebagai penyambung tangan/perantara saja tanpa menambahkan/mengubah jumlah denda sepeser pun. Dan seandainya pun sudah mendaftar namun batal mengikuti DP Course, kami mohon dengan sangat agar diberitahukan kepada kami, dan jangan kabur begitu saja tanpa kabar, agar kami ada kepastian dan dapat mengisi seat yang sudah terdaftar tersebut dengan peserta lain yang berminat. Karena hal tersebut juga merugikan anda sendiri, karena nama anda sudah terdaftar di C-Mar sebagai student namun kabur tanpa berita. Kami hanya membantu anda saja untuk mendaftar.

Human Error Multipliers

Studies show that up to 80% of network availability incidents can be tied to human error. In addition, the fourth annual CompTIA study on security breaches shows that 60% can be attributed to human error. With statistics proving over and over that human error should be of concern, it is a wonder that more attention is not paid to managing it. In fact, there are a number of behaviors that can dramatically increase the odds of human error yet organizations fail to manage them.

All services contain some element of human interaction and thus some level of inherent variation. It may be introduced at any point during the life cycle from a wide range of vectors including development, operations, vendors, users, etc. Moving past the inherent baseline that can not be eliminated, additional levels of human error-related variation can be injected into challenged organizations. The following can all cause the level of human error in organizations to increase and thus put the attainment of goals and objectives at risk:

Increased Complexity – As the volume of systems, variety, integration and coupling increases, so to does the inherent complexity of the environment. This causes a situation wherein a significant amount of detailed knowledge around services rendered is distributed and the impacts of proposed changes are largely unknown. As a result, the likelihood of a change negatively impacting confidentiality, integrity or availability increases.
Operating Under Tight Deadlines – As the level of pressure to complete work increases there reaches a point where the emphasis may shift to “just get it done” wherein appropriate controls are bypassed in favor of completing work. As a result, mistakes are made and not caught. Standards are not followed and variation increases. Fatigue and stress levels increase and so on.
Human Fatigue – Studies have clearly tied fatigue with increases in human error. As people begin to perform without sufficient rest, the likelihood of errors increases. Expecting staff to perform without error despite working long hours is unrealistic.
Task Switching – A person split between a given number of tasks is likely to make mistakes due to shifts in concentration and delays between actions. It is a falsehood to think that a three tasks requiring a third of a full-time equivalent each can be handled by one person. As the number of tasks increases, the likelihood of error increases.
Insufficient Planning – Projects that invest the time and resources in planning prior to commencing work are far more likely to deliver on time and within budget. Failure to adequately plan may cause budget and schedule pressures to arise thus causing personnel to rush, work long hours, and bypass standard policies and procedures.
Insufficient Testing – When project schedules and/or budgets are at risk, one of the first areas to suffer is testing. As a result, the risk that human errors will not be caught prior to production increases.
Lack of Change Management – Human error is introduced via changes to production systems. When changes are not properly managed then risks to production and the business increases.
Development on Production Systems – Changes can and do fail. If development is allowed to change a production system directly then the odds of human error negatively impacting the organization increases.
Functional Silos –When functional areas are allowed to design services without the enterprise’s interests taken into account, then the level of variation and complexity in the environment will increase.
Inability to Criticize – In organizations where review and constructive criticism are stifled then the levels of unplanned reactive activities will only increase. Review should be designed into formal change management processes.
Lack of Communication – When modifications to systems are planned in isolation then the chances of dependencies causing incidents increases.
Lack of Documentation – When complex systems are not documented then it becomes increasingly difficult to train new people, understand the potential impacts of changes, etc.
Lack of Standards – As variation increases, the more people must try to learn and memorize increases. For example, it is easier to gain deep knowledge of three platforms versus 30. Similarly, for several processes versus differences between every employee.
Lack of Shared Objectives – If the objective for doing something isn’t clearly articulated and understood then the chances of individuals drifting from the intended objective increases.
Lack of Training – If people are not adequately trained on a new service, or specific system, then how can they possibly operate or support it without introducing errors?
Lack of Understanding Causality – When groups do not understand historical outcomes and formally track cause and effect then how can the culture evolve and risk behaviors be avoided?
Lack of Control and Process Knowledge – IT has long focused on technology to solve problems. Now, to enable the attainment of functional area objectives and organizational goals in a sustainable manner then proper control and process design must be coupled with the right people and technology. Without proper controls and processes, then risks from human error and other vectors will only increase.
The above is a partial list intended to invoke discussion. What we have witnessed during consulting engagements is that some organizations may have multiple behaviors that when combined further increase risk levels. Organizations must take a careful look at their culture and processes to understand and subsequently manage the level of human error being introduced. If we want to help safeguard the organization and its goals, then it is essential to understand what causes human error levels to increase and correspondingly, what can be done to reduce those levels.


AMANDEMEN STCW 2010: APA YANG PERLU ANDA KETAHUI

Telah secara luas diketahui bahwa IMO mengadakan Konferensi Diplomatik di Manila, Filipina, pertengahan tahun 2010 untuk membahas amandemen STCW. Banyak orang yang tidak mengetahui pada tingkat apa revisinya dan realitas implementasinya di balik hal tersebut. Untuk meluruskan hal-hal tersebut mari kita lihat apa yang telah terjadi langkah demi langkah.
Amandemen STCW Manila.
Pada 25 Juni 2010, Organisasi Maritim Internasional (IMO) serta stakeholder utama lainnya dalam dunia industry pelayaran dan pengawakan global secara resmi meratifikasi apa yang disebut sebagai “Amandemen Manila” terhadap Konvensi Standar Pelatihan untuk Sertifikasi dan Tugas Jaga bagi Pelaut (STCW) dan Aturan terkait. Amandemen tersebut bertujuan untuk membuat STCW selalu mengikuti perkembangan jaman sejak pembuatan dan penerapan awalnya pada tahun 1978, dan amandemen selanjutnya pada tahun 1995.

Mulai Berlakunya.
Amandemen Konvensi STCW akan diterapkan melalui prosedur penerimaan dengan pemahaman yang telah disepakati yang mengisyaratkan bahwa perubahan tersebut sudah harus diterima paling lambat 1 Juli 2011 KECUALI bila lebih dari 50% dari para pihak terkait STCW menolak perubahan yang demikian. Sebagai hasilnya, Amandemen STCW ditetapkan mulai berlaku pada tanggal 1 Januari 2012.

Tujuan Amandemen STCW.
Hal-hal berikut menguraikan perbaikan-perbaikan kunci yang diwujudkan melalui Amandemen baru, yaitu:
1. Sertifikat Kompetensi & Endorsement-nya hanya boleh dikeluarkan oleh Pemerintah – sehingga mengurangi kemungkinan pemalsuan sertifikat kompetensi.
2. Pelaut yang telah menjalani pemeriksaan kesehatan sesuai Standar medis umum untuk pelaut dari satu negara dapat berlaku di kapal yang berasal dari negara lain tanpa menjalani pemeriksaan medis ulang.
3. Persyaratan revalidasi sertifikat dirasionalisasi untuk kepentingan pelaut.
4. Pengenalan metodologi pelatihan modern seperti pembelajaran jarak jauh dan pembelajaran berbasis web.
5. Jam istirahat bagi pelaut dikapal diselaraskan dengan persyaratan Maritime Labor Convention ILO/MLC (Konvensi Buruh Maritim ILO) 2006, dengan maksud untuk mengurangi kelelahan.
6. Memperkenalkan persyaratan-persyaratan tambahan untuk menghindari alkohol dan penyalahgunaan zat terlarang.
7. Kompetensi dan kurikulum baru harus terus diperbarui mengikuti perkembangan teknologi modern dan kebutuhan riil dilapangan.
8. Pelatihan penyegaran dibahas dengan layak dalam konvensi.

Beberapa hal pokok terkait amandemen STCW 2010, adalah sebagai berikut :
Bab I Ketentuan Umum.

• Peraturan I / 2: Hanya Pemerintah yang dapat mengeluarkan Certificate of Competency (COC) dan menyediakan database elektronik untuk verifikasi keaslian sertifikat.
• Peraturan I / 3: Persyaratan Near Coastal Voyage dibuat lebih jelas, termasuk principal yang mengatur pelayaran dan melakukan “kegiatan usaha” dengan Pihak yang terkait (negara bendera dan negara pantai).
• Peraturan I / 4: Penilaian/pemeriksaan Port State Control (PSC) terhadap pelaut yang melaksanakan tugas jaga dan standar keamanan – “Harus memenuhi Standar keamanan” dalam daftar.
• Peraturan I / 6: Pedoman e-learning (pembelajaran elektronik)
• Peraturan I / 9: standar Medis diperbaharui sejalan dengan Persyaratan ILO MLC.
• Peraturan I/11: Persyaratan revalidasi dibuat lebih rasional dan termasuk persyaratan revalidasi atas endorsement sertifikat kapal tanker.
• Peraturan I/14 : Perusahaan bertanggung jawab terhadap pelatihan penyegaran pelaut di kapal mereka

STCW Bab II, Level Dukungan
Bab Dua adalah bagian Departemen Dek. Perubahan utama dalam Bab II adalah penambahan Pelaut Trampil (Able Seafarers/AB) – Deck Rating. Ini terpisah dari Rating yang melaksanakan tugas jaga Navigasi (Rating Forming Part of a Navigational Watch / RFPNW).
Berdasarkan persyaratan untuk bekerja dikapal, penting bagi pelaut untuk mendapatkan kualifikasi RFPNW sebisa mungkin pada awal sekali dari karir mereka. Pelaut tidak secara otomatis mendapat kualifikasi AB sampai kualifikasi RFPNW telah dipenuhi dan lisensi tersebut harus mendapatkan sertifikat pengukuhan (endorsement) AB. Ini akan membutuhkan pelatihan dan pengujian serta akan menjadi pasal baru yang disebut A-II / 5.

STCW Bab II, Level Operasional dan Manajemen.
Untuk Electronic Chart Display and Information System / ECDIS (Peta dan Sistim Informasi Elektronik), perlu pelatihan bagi semua Perwira Dek untuk semua kapal yang dilengkapi dengan ECDIS. Pelatihan ECDIS dilaksanakan sama seperti pelatihan ARPA ataupun GMDSS, dimana ada pembatasan dalam STCW yaitu seseorang tidak boleh bekerja di kapal dengan perlengkapan tersebut jika ia tidak memiliki sertifikat ECDIS.
Pada 2012 hampir semua kapal dengan bobot mati lebih dari 200 ton akan diatur di bawah hukum yang terpisah untuk memiliki peralatan ECDIS. Secara otomatis, setiap Perwira Dek dikapal berbobot lebih dari 200 ton akan membutuhkan pelatihan ECDIS. Akan ada dua tingkat ECDIS, yakni operasional dan manajemen dengan tanggung jawab yang berbeda dari masing-masingnya. Manajemen SDM yang bertugas di anjungan kapal, Pelatihan Tim Kerja dan Kepemimpinan akan diwajibkan baik di tingkat operasional maupun manajemen.

STCW Bab III, Mesin
Perubahan utama dalam Bab III adalah penambahan Pelaut Trampil bagian Mesin (Engine Rating). Ini terpisah dari rating yang melaksanakan tugas jaga mesin.
Banyak negara hanya memiliki level rating yang melaksanakan tugas jaga (Rating Forming Part of a Enginee Watch / RFPEW), dan untuk pelaut trampil pemula dibagian mesin disyaratkan memiliki sertifikat RFPEW sesuai ketentuan STCW. Ini akan membutuhkan pelatihan dan pengujian dan akan menjadi pasal baru yang disebut A-III/5.
Pasal A-III/1 akan diformat ulang dan diatur kembali. Anda tidak lagi perlu melakukan pelatihan selama 30 bulan di kamar mesin yang disetujui. Kata-katanya sekarang akan lebih disinkronkan dengan departemen dek dan berbunyi tiga tahun masa kerja di laut dengan satu tahun gabungan keterampilan bengkel dan enam bulan jaga mesin (engine room watchstanding).
Perwira Teknik Elektro (Electro Technical Officer/ETO) dan Bawahan Teknik Elektro (Electro Technical Rating/ETR) akan ditambahkan.
Manajemen SDM di Kamar Mesin, Pelatihan Tim Kerja dan pelatihan Kepemimpinan akan diwajibkan baik di tingkat operasional maupun manajemen.

STCW Bab V, Tanker dan Kapal Tanker:
Sekarang akan ada tiga kategori Awak kapal Tanker pada kapal tanker, yaitu:
• Awak kapal tanker Minyak.
• Awak kapal tanker Kimia.
• Awak kapal tanker Gas Cair.
Selain itu, setiap kategori Awak kapal tanker akan dipisahkan atas dua tingkat, yaitu :
• Dasar (saat ini disebut asisten).
• Lanjutan (saat ini disebut Penanggung Jawab (PIC).
Yang akan menjadi perubahan besar adalah pemisahan bahan kimia dari minyak dan masing-masing memerlukan prasyarat tersendiri untuk diawaki pada setiap jenis kapal dan pelatihan khusus untuk masing-masingnya. Selain itu, akan ada Kursus Pemadaman Api di Kapal Tanker, meskipun beberapa pihak memperbolehkan Program Pemadaman Api Dasar untuk menutupi persyaratan ini.
Kapal Penumpang – Akan ada konsolidasi aturan untuk kapal penumpang.
Offshore Supply Vessels (OSV)/Kapal Supply Offshore, Dynamis Positioning (DP) Vessels/Kapal dengan Kendali Posisi Dinamis dan kapal yang beroperasi di Perairan yang Tertutupi Es: Akan ada pasal baru yang memuat panduan terkait lisensi khusus atau persyaratan pelatihan untuk OSV, DPV dan kapal yang beroperasi di Perairan yang Tertutupi Es.

STCW Bab VI, Isu Lingkungan Laut:
Amandemen akan mencakup penambahan isu kesadaran lingkungan laut dalam Kursus Keselamatan Pribadi & Tanggung Jawab Sosial (Personal Safety & Social Responsibilities/PSSR) yang dilaksanakan sebagai bagian dari Pelatihan Keselamatan Dasar (Basic Safety Training/BST) serta tingkat operational yang memperhatikan kelestarian lingkungan laut pada setiap tingkatan sertifikasi sesuai STCW Code A-II / 1 dan A-III / 1.

Pelatihan Keselamatan Dasar (BST) :
Cakupan PSSR akan ditambahkan beberapa subyek sebagai berikut :
• Komunikasi.
• Pengendalian Kelelahan.
• Tim Kerja.
Subyek tambahan ini akan membuat modul PSSR lebih panjang tapi harus kurang dari satu hari panjangnya. Tetap saja, ini akan memperpanjang program Pelatihan Keselamatan Dasar dari yang biasanya lima hari menjadi setidaknya 5,5 hari.

Pelatihan Penyegaran untuk Keselamatan :
Salah satu elemen kunci dari amandemen STCW 2010 tampaknya adalah penghapusan celah yang berkaitan dengan pelatihan penyegaran. Kode (Aturan) STCW, yang kabur di area ini menyebabkan banyak negara memilih untuk menafsirkan persyaratan “dalam waktu lima tahun” secara longgar. Telah diputuskan bahwa program tertentu yang dapat mempengaruhi keselamatan dan kelangsungan hidup awak kapal dan penumpang mewajibkan latihan penyegaran pengendalian keadaan darurat / keselamatan dilaksanakan secara berkala.
Latihan penyegaran keselamatan dapat dilaksanakan dalam bentuk e-learning (pembelajaran secara elektronis), latihan di atas kapal atau pelatihan di darat.
Kursus keselamatan akan memerlukan pelatihan penyegaran setiap lima tahun dan program pelatihannya dapat diperpendek dari panjang durasi pelatihan aslinya. Latihan penyegaran dengan metode yang disetujui (di kelas atau kapal – belum ditentukan) adalah:
• Proficiency in Survival Craft and Rescue Boats (SCRB).
• Advanced Firefighting (AFF).
• Basic Safety Training (BST).
• Fast Rescue Boat.
• Medical Training.

Pelatihan Keamanan.
Amandemen akan mencakup tiga tingkat pelatihan keamanan
• Tingkat Satu – Kesadaran Keamanan (Semua anggota kru)
• Tingkat Dua – Petugas Keamanan
• Tingkat Tiga – Ship Security Officer (Perwira Keamanan Kapal) – ISPS Code
Pelatihan Anti Pembajakan juga akan ditambahkan pada setiap level/tingkat.

STCW Bab VIII: Tugas Jaga.
Bagian Aturan STCW ini akan diselaraskan dengan ILO MLC. ILO MLC telah ditandatangani pada tahun 2006 dan dibuat sebagai aturan baru yang mengatur hak para pelaut sehingga akan ada standar minimum global tentang bagaimana pelaut diperlakukan.

Harmonisasi dengan IMO MLC
Ketika IMO (International Maritime Organization) melakukan pengawasan atas sertifikasi berdasarkan Konvensi STCW, ILO melakukan pengawasan terhadap pelaksanaan Konvensi MLC. Ketika ILO mengadopsi “Seafarers Bill of Rights” (Hak-Hak Dasar Pelaut) bagi para pelaut di dunia, semua pihak – pemerintah, pelaut dan pemilik kapal – memuji standar kerja baru ini sebagai perkembangan penting bagi sektor industri dunia yang paling terglobalisasi.
IMO telah mengambil langkah penting untuk membangun perlindungan di bidang keselamatan, sertifikasi dan polusi, tetapi sektor ini dibanjiri dengan berbagai standar ketenagakerjaan internasional dari sejak lebih dari delapan dekade terakhir. ILO MLC 2006 memodernisasi standar-standar ini untuk:
1. Konsolidasi dan memperbarui lebih dari 60 Konvensi ILO dan Rekomendasi-rekomendasinya yang telah pernah dibuat sebelumnya.
2. Menetapkan persyaratan minimum bagi pelaut untuk bekerja pada sebuah kapal.
3. Menangani kondisi kerja, akomodasi, fasilitas rekreasi, makanan dan katering, perlindungan kesehatan, perawatan medis, perlindungan kesejahteraan dan jaminan sosial.
4. Mempromosikan kepatuhan bagi operator dan pemilik kapal dengan memberikan fleksibilitas yang cukup pada pemerintah untuk menerapkan persyaratan dalam cara yang terbaik disesuaikan dengan undang-undang nasional masing-masing negara.
5. Memperkuat mekanisme penegakan/pelaksanaan pada semua tingkatan, termasuk ketentuan untuk prosedur keluhan yang tersedia bagi pelaut, pengawasan yang dilakukan oleh para pemilik kapal dan nakhoda terhadap kondisi kapal-kapal mereka, yurisdiksi negara bendera dan kontrol atas kapal mereka, dan inspeksi negara pelabuhan pada kapal asing.

Kesimpulan
STCW ada untuk diberlakukan. Isu yang paling menarik tentang amandemen baru adalah bahwa SCTW amandemen 2010 akan diimplementasikan lebih jauh dari MLC ILO. Amandemen baru menggabungkan periode fase 5 tahun untuk pelaut yang sudah ada sekarang dan pada saat yang sama mewajibkan adanya semua perubahan nyata seperti Jam Kerja & Istirahat untuk diterapkan pada 1 Januari 2012.

US settles Cosco Busan spill for $44M
OWNERS and operators of the Cosco Busan were ordered to pay $44M to settle a civil lawsuit in the aftermath of the 2007 oil spill in San Francisco Bay.

Vessel owner Regal Stone and ship management company Fleet Management were held liable yesterday (19 September) for damages caused by the spill, which occurred after the containership struck the San Francisco-Oakland Bay Bridge.

The 53,000 gallons of oil that leaked as a result devastated wildlife in the area, killing thousands of migratory birds and fish and oiling over 100 miles of shoreline.

“With this settlement, we are seeing to it that those responsible for the spill are held accountable and that they pay their share for restoring and improving our precious natural resources and public lands”, US Interior department secretary Ken Salazar said in a statement.

Federal, state, and local government agencies will receive payments from the penalty based on damages incurred.

The $18.8M portion of the settlement for lost human uses of the shoreline and the bay constitutes one of the largest human use recoveries for any oil spill in the US, according prosecutors.

Hong Kong-based Fleet was previously ordered to pay $10 million in criminal penalties after being found negligent in the accident and for obstruction of justice in a cover-up in which it falsified ship records after the crash.

John Cota, the ship’s pilot, pleaded guilty in 2009 and was sentenced to 10 months in prison.

GENERAL HSE INDUCTION FOR VISITORS
Before entering construction site,you need to know more about work activities,hazards,dangers and HSE rules on the site.

1. your company should have registered you with the compensation commisioner or
similiar organization.please show your ID card and a copy of your letter of good standing.
2. You are responsible for your own safety and those around you.
3. You are required to provide your own safety boots,the hardhat,safety glasses(not
sunglasses),and reflector vest issued to you must be returned.
4. You are only allowed to enter the site in the company of a site representative.
5. Follow instructions and be alert of the high risk activities around you.
6. Material and or equipment could fall onto you,Be aware of what is above you.
7. Be careful when walking on site as you can fall over equipment,material or into a hole.
8. When there are lifting machinery which has the right of way and the operators’ vision is
limited,Take care and stay out of their way.
9. When there are lifting machines on site, do not walk underneath any hoisted load.
10. There are numerous safety signs on site,take note of these signs and obey the signs.
11. Do not enter any area where white and red tape or physical barricading has been
erected around an activity.
12. Do not climb into excavations or onto any high structures including scaffolding without using safety harness.
13. Do not enter the site when under the influences of alcohol or any other narcotics.
14. Do not get any involved in any physical assault while on site.
15. Report any near miss incident or injury to the Site Management before you leave site.
16. Do not endanger any person while on site.
17. Hand carrier maybe search using a hand-held metal and or explosive detectors or other means,depending on security level.
18. Never learn about work from the accident.
